Agreement to Terms
By accessing and using VermontTaxAppeal.com and agreeing to work with us for property tax grievance services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our website or request our services.
Service Description
VermontTaxAppeal.com provides property tax grievance consulting services for residential and commercial properties throughout Vermont. Our services include:
- • Free property tax assessment and case evaluation
- • Representation in property tax grievances before town listers and the Board of Civil Authority
- • Preparation of evidence packages including income analysis and comparable sales
- • Advocacy for reduction of assessed value
Contingency Fee Model
Our fee structure is contingency-based. This means:
- • You pay 30% of first-year tax savings if we achieve a reduction
- • You pay nothing if we do not reduce your assessed value
- • You pay nothing in year two or beyond, regardless of ongoing savings
- • You are not responsible for court costs, filing fees, or other legal expenses
No Guarantee of Results
While we exercise professional skill and judgment in evaluating and pursuing your grievance, we cannot guarantee a specific outcome or result. Property tax grievances are subject to the judgment of town listers and the Board of Civil Authority. Outcomes depend on factors beyond our control, including municipal decisions, comparable property data, and local assessment practices.
Our initial free assessment is an honest evaluation of case strength. However, final outcomes depend on the decision-makers involved in your grievance.
Client Responsibilities
As a client, you agree to:
- • Provide accurate and complete information about your property
- • Respond promptly to requests for information or documentation
- • Pay the agreed contingency fee if we achieve a reduction
- • Notify us of any changes to your contact information or property status
- • Not misrepresent facts about your property or situation
Representation & Authority
Once you sign our Agent Authorization form, you grant VermontTaxAppeal.com the authority to represent you before town listers, the Board of Civil Authority, and any related grievance proceedings in Vermont. You authorize us to file documents, present evidence, and negotiate on your behalf.
Termination of Services
Either party may terminate our representation with written notice. If you terminate before a settlement is reached, you remain responsible for any fees owed for work performed and settlement already achieved. If we decline a case or recommend non-representation, no fees are owed.
Jurisdiction & Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Vermont, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under or related to these terms shall be subject to the exclusive jurisdiction of the courts of Vermont.
Disclaimer of Warranties
Our services are provided "as is" without any warranties, express or implied. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be error-free, uninterrupted, or lead to any specific result.
Limitation of Liability
To the extent permitted by Vermont law, VermontTaxAppeal.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, even if advised of the possibility of such damages.
Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective when posted to our website. Your continued use of our services following any modification indicates your acceptance of the revised terms.
